You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
AviGation grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the platform for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to resell, reproduce, distribute, or create derivative works from the content, design, or layout of the platform without prior written consent from ICTC Learning Solutions Private Limited.
By using the AviGation platform and providing your contact information, you consent to receiving communications from us. These communications may include but are not limited to: newsletters, marketing materials, promotional offers, updates about courses and services, and transactional emails related to your account or enrolled courses. You may opt out of marketing communications at any time by following the unsubscribe instructions provided in the emails or by contacting us directly.
When using the AviGation platform, you agree to the following code of conduct:
(a) You will not use the platform for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
(b) You will not attempt to gain unauthorized access to any portion of the platform, other user accounts, or any systems or networks connected to the platform.
(c) You will not use any automated means, including bots, scrapers, or spiders, to access or collect data from the platform unless expressly permitted by AviGation.
(d) You will not upload, post, or transmit any content that is harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
(e) You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.
(f) You will not interfere with or disrupt the platform, servers, or networks connected to the platform.
(g) You will not reproduce, duplicate, copy, sell, resell, or exploit any portion of the platform without express written permission from AviGation.
(h) You will not use the platform to transmit any unsolicited advertising, spam, or promotional materials.
(i) You will not engage in any conduct that restricts or inhibits any other user from using or enjoying the platform.
(j) You will comply with all applicable laws and regulations regarding your use of the platform and any content, materials, or services obtained through the platform.
All content, trademarks, service marks, logos, trade names, and any other intellectual property displayed on the AviGation platform are the property of ICTC Learning Solutions Private Limited or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, modify, distribute, or display any of this intellectual property without prior written consent from AviGation. The AviGation name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ICTC Learning Solutions Private Limited or its affiliates.
If you provide AviGation with any feedback, suggestions, ideas, or other submissions regarding the platform, services, or content, you agree that such feedback becomes the property of ICTC Learning Solutions Private Limited. We shall be entitled to use, reproduce, disclose, and distribute such feedback for any purpose without restriction, compensation, or attribution to you. You waive any rights to claim ownership or seek compensation for any feedback you provide.
AviGation offers various courses, programs, and services that may require payment. All fees are displayed in Indian Rupees (INR) unless otherwise stated. Payment must be made through the approved payment methods available on the platform. Refunds, if applicable, shall be processed in accordance with the refund policy outlined at the time of purchase. AviGation reserves the right to modify its pricing and refund policies at any time without prior notice. Any disputes regarding payments must be raised within 7 days of the transaction date by contacting us at icoachthecoach@gmail.com.
The AviGation platform and all content, materials, and services provided through the platform are offered on an "as is" and "as available" basis without any warranties, express or implied. ICTC Learning Solutions Private Limited does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any content for any particular purpose. Your use of the platform and any reliance on the content is solely at your own risk.
To the maximum extent permitted by applicable law, ICTC Learning Solutions Private Limited, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the platform. In no event shall our total liability exceed the amount paid by you, if any, to ICTC Learning Solutions Private Limited during the twelve (12) months immediately preceding the claim or INR 1,000, whichever is greater.
You agree to indemnify, defend, and hold harmless ICTC Learning Solutions Private Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the AviGation platform; (b) your violation of any term of these Terms of Use; (c) your violation of any third-party right, including any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party. You hereby release ICTC Learning Solutions Private Limited from any and all claims, demands, and damages of every kind arising out of or in connection with your use of the platform.
The AviGation platform may contain links to third-party websites or services that are not owned or controlled by ICTC Learning Solutions Private Limited. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. The inclusion of any links does not imply endorsement or recommendation by AviGation. You acknowledge and agree that ICTC Learning Solutions Private Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods, or services available on or through any such third-party websites.
These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms of Use, or the breach thereof, shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
(a) Entire Agreement: These Terms of Use constitute the entire agreement between you and ICTC Learning Solutions Private Limited regarding the use of the AviGation platform and supersede all prior agreements and understandings, whether written or oral.
(b) Severability: If any provision of these Terms of Use is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
(c) Waiver: The failure of AviGation to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
(d) Assignment: You may not assign or transfer these Terms of Use, by operation of law or otherwise, without the prior written consent of ICTC Learning Solutions Private Limited. AviGation may assign or transfer these Terms of Use, in whole or in part, without restriction.
(e) Modifications: AviGation reserves the right to modify these Terms of Use at any time at its sole discretion. Any changes will be effective immediately upon posting on the platform. Your continued use of the platform after any such modifications constitutes your acceptance of the revised Terms of Use. We encourage you to review these Terms periodically.
